These terms are the agreement between you and MakeHelm Ltd ("we", "us") for using Helmet Designer at helmetdesigner.com. By using the site you agree to them. They're written to be read; if anything is unclear, email hello@helmetdesigner.com.
1. The service
Helmet Designer is a browser tool for designing helmet paint schemes in 2D and previewing them in 3D. Designing is free and doesn't need an account. An account lets you save designs and share them with a link. Pro is an optional one-time purchase that unlocks extra features on your account.
Helmet Designer is a visual design tool, not a safety product. It says nothing about the safety, certification or fit of any real helmet. If you paint or wrap a real helmet, follow its manufacturer's guidance (some paints and solvents can weaken a shell).
2. Your account
- Give a real email address you can receive mail at, and keep your password to yourself. You're responsible for what happens under your account.
- You must be at least 13 to create an account. If you're under 18, you need a parent or guardian's permission to buy Pro.
- You can delete your account at any time from your account page. That deletes your saved designs too.
3. Your designs and content
- You own what you make. The designs you create, and the logos and images you upload, stay yours.
- The licence you give us: so we can run the service, you give us a worldwide, non-exclusive, royalty-free licence to store, copy, render, display and send your designs and uploads, only as needed to provide Helmet Designer to you and to the people you share them with (for example, showing a shared design and its preview picture on its share page, or in link previews in other apps). The licence ends when you delete the design or your account, apart from routine backups that roll over and copies others have already saved.
- Shared designs are public at their link. Anyone with the link can view a shared design. You can turn sharing off at any time from My designs.
- Only upload what you have the right to use. Team and sponsor logos, brand names, trade marks and other people's artwork usually belong to someone else. Recreating a famous driver's or team's helmet as a tribute is up to you: you're responsible for making sure your use is allowed, especially if you share it or have a real helmet painted.
- The tools, helmet models, preset designs, fonts and the site itself belong to us or our licensors. You can use designs you make with them freely, including on a real helmet.
4. Rules of the road
Don't use Helmet Designer to:
- upload or share anything unlawful, hateful, sexually explicit, or that infringes someone else's rights;
- impersonate someone or mislead people about who made a design;
- break, overload, scrape or probe the service, or get around Pro or account limits.
We may remove content or suspend accounts that break these rules, and we'll tell you why unless the law or safety stops us.
5. Intellectual property complaints
If you think a shared design infringes your copyright, trade mark or other rights, email hello@helmetdesigner.com with the design's link, what you own, and how to reach you. We'll look into it promptly and may remove or unshare the design while we do.
6. Pro
- Pro costs a one-time $17 USD. It's not a subscription and never renews.
- It's a licence to use the Pro features on the account you bought it with, for as long as we run Helmet Designer. It can't be moved to another account.
- Payment is taken by Stripe. Your card may charge you in another currency at its own exchange rate.
- We may add, change or improve Pro features over time, but we won't take away the core of what you paid for (unlimited saves, the premium finishes and exports) while the service runs.
- If we ever close Helmet Designer we'll give at least 60 days' notice so you can download your designs.
- Pro starts as soon as your payment completes. By buying, you agree to that and acknowledge that you lose the 14-day right to cancel that would otherwise apply to digital content.
7. Availability
We work to keep Helmet Designer running and your designs safe, but we provide it "as is": we can't promise it will always be available, error-free, or suitable for a particular purpose. Keep your own copies of anything important (Export saves a picture of your design).
8. Our liability to you
- Nothing in these terms limits liability that can't be limited by law, including for death or personal injury caused by our negligence, for fraud, or your rights under the Consumer Rights Act 2015.
- We're responsible for loss you suffer that's a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We're not responsible for loss that wasn't foreseeable.
- Helmet Designer is for personal, non-commercial use. If you use it for a business, we're not liable to you for lost profit, revenue, business or opportunity, and our total liability is limited to what you paid us in the 12 months before the claim.
9. Changes and ending
We may update these terms as the service changes. If a change matters, we'll tell signed-up users by email before it applies; carrying on using the service after that means you accept it. You can stop using Helmet Designer and delete your account at any time.
10. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland, you can also bring proceedings there, and if you live elsewhere you keep any protections your local consumer law gives you.
